Communication of Fundació Universitària Martí l’Humà (from now on ‘FUMH’) domain names to the corresponding Registers
FUMH declares that it has notified the Register of Foundations of the domain names currently in use, pursuant to Article 9 of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce.


TERMS OF USE

General Conditions and Acceptance

These general terms of use of the website, together with the general terms and conditions of the services provided, and any specific conditions that may be established, aim to regulate and inform users of the FUMH services and regulate the use of the website.

Browsing and using the website services implies the user’s full acceptance, without any reservation, of all the general terms of use, the general contracting terms, and any others related to the provision of FUMH services.

FUMH may, at any time and without prior notice, modify these general conditions and any other applicable terms by publishing said modifications on the website so that users are informed beforehand.


PERSONAL DATA PROTECTION POLICY

In accordance with the European General Data Protection Regulation (GDPR) 679/2016 of April 27, the user agrees to the inclusion of data obtained while browsing the website or provided through any form, as well as those derived from commercial or collaborative relationships, in an automated personal data file.

During the data collection process, and in sections where data is requested, the user will be clearly informed—via hyperlink or within the form itself—about whether providing the data is mandatory for the service.

User Rights:
The user may exercise their rights under the GDPR, particularly rights of access, rectification, erasure, objection, portability, and restriction of processing.

These rights can be exercised by postal mail (with a copy of ID or passport) to:

According to Article 25.2 of the GDPR, FUMH has adopted the necessary technical and organizational measures to ensure that only the strictly necessary data are processed by default.

INTELLECTUAL AND INDUSTRIAL PROPERTY

FUMH owns or holds the appropriate licenses for the exploitation rights of the website, the platform, the courses offered, and all content therein (texts, images, logos, designs, etc.).

Access and use of the website by users does not imply any waiver, transfer, or license of FUMH’s rights.

Users are granted a strictly personal and non-commercial right to use the website and its services under this Legal Notice.

Any use of registered trademarks or trade names, whether by FUMH or third parties, is prohibited without prior written consent.

All rights are reserved. Modifying, copying, reproducing, publicly communicating, or distributing the website’s content for commercial purposes without written authorization is prohibited.

Users may not remove or manipulate copyright notices or digital watermarks.

Users accept full responsibility for any information provided in their name.

If users become aware of illegal content or rights violations, they must notify FUMH at info@fumh.cat.
Any third party who believes their rights have been violated must provide:

  • Identification and contact details

  • Proof of ownership of the allegedly infringed rights

  • A detailed description and location of the alleged violation

  • A declaration stating that the use of the content occurred without consent


FUMH LIABILITY

Users acknowledge that the use of the website and its services is under their sole responsibility.

FUMH is only liable for damages caused by intentional misconduct.

Nonetheless, FUMH declares it has taken all necessary measures, within its capabilities and technical standards, to ensure proper operation of the website and prevent viruses or harmful components.


USER OBLIGATIONS

Users agree to use website content properly, lawfully, and respectfully. They must refrain from:

  • Using content for illegal or immoral purposes

  • Reproducing or modifying content without authorization

  • Sending unsolicited commercial communications using website content


COMMERCIAL COMMUNICATIONS

FUMH may send commercial communications by any means (email, mail, etc.), always in accordance with data protection laws.

For email marketing, user consent is required.
Users may revoke their consent at any time by emailing FUMH.


APPLICABLE LAW

User and FUMH relationships are governed by applicable Spanish law.

Where jurisdiction choice is permitted, both parties expressly submit to the courts of Barcelona, waiving any other forum.


GENERAL CONTRACTING CONDITIONS

These General Contracting Conditions, along with any specific conditions, govern the relationship between FUMH and users who purchase services via the website.

They are based on:

  • Law 7/1998 on General Contracting Conditions

  • Law 3/2014 on Consumer Protection

  • Law 7/1996 on Retail Trade

  • Law 34/2002 on Information Society Services

Using any website service implies full acceptance of all terms and procedures.

FUMH may provide a username and password to access services, which are personal and non-transferable.

Contracts are governed by Spanish law. In case of dispute, the courts of Barcelona will apply.


REFUND, CANCELLATION AND REIMBURSEMENT POLICY

If the minimum number of students is not reached, FUMH may cancel the course and refund all fees.

Refunds are made within 15 working days by bank transfer.

If a student accesses Moodle before the course starts, the course is considered started and no refund will be given.

After the official start date (first day of synchronous/asynchronous training), no refunds are granted.
Cancellation requests must be submitted in writing to administracio@fumh.cat before the start date to be eligible for a refund (minus handling fees).

If a student with an installment plan withdraws, they must pay all installments regardless of attendance.


RIGHT OF WITHDRAWAL

In accordance with Royal Legislative Decree 1/2007, students have 14 calendar days from enrollment to withdraw, without penalty or justification, using the withdrawal form.

Full refunds are issued if:

  • The withdrawal is within 14 calendar days

  • The student has not accessed the virtual campus

  • The payment has been confirmed

Courses with installment payment are excluded from this right.

FUMH will issue the refund within 14 calendar days of accepting the withdrawal.


RIGHT OF ADMISSION

FUMH reserves the right to admit or deny enrollment or access to the virtual campus if a student does not meet the necessary requirements.
